Welcome to Ocemiam. These Terms of Service ("Terms") govern your access to and use of ocemiam.com (the "Site") and any products purchased through it. By placing an order, browsing, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Ocemiam is an Oregon-based bakery brand offering French Baby Cakes, Banana Bread, and related products for sale online and through select retail partners.

2. Eligibility

3. Products

  • All products are food items and are described to the best of our ability, including ingredients and allergen information where applicable. Product images are for illustrative purposes; actual appearance may vary slightly.
  • Allergens: Our products are baked in a facility that may process nuts, dairy, eggs, wheat, and other common allergens. Please review ingredient information carefully before ordering if you have food allergies or sensitivities.
  • We reserve the right to limit quantities, discontinue products, or modify recipes and packaging at any time without prior notice.

4. Orders and Payment

  • By placing an order, you are making an offer to purchase the product(s) selected, subject to acceptance by Ocemiam.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel an order after payment, you will receive a full refund.
  • Prices are listed in U.S. dollars and are subject to change without notice. Applicable sales tax will be added at checkout based on your shipping address.
  • Payment is processed securely through our third-party payment provider(s). We do not store your full payment card information.

5. Shipping and Delivery

  • We ship within the United States. Estimated delivery times are provided at checkout but are not guaranteed, as they depend on carrier performance and other factors outside our control.
  • Because our products are perishable, please ensure someone is available to receive your package promptly upon delivery. Ocemiam is not responsible for spoilage resulting from delayed pickup after successful delivery to the address provided.
  • Risk of loss and title for products pass to you upon delivery to the carrier.

6. Returns and Refunds

Because our products are perishable food items, we do not accept returns. Refunds and replacements for quality or delivery issues are handled under our separate Refund Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

All content on the Site — including the Ocemiam name, logo, product names, photography, and written content — is the property of Ocemiam or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written consent.
